## Electronic signatures: where the detail lives

Smart Sign has its own site with a documented blog, and its own llms.txt at
https://sign.wallid.io/llms.txt. For questions about electronic signature law,
signature levels, or free contract templates in Portuguese, that is the better source.

Key facts, with the legal basis:

- **A qualified electronic signature (QES) has the same legal effect as a handwritten
  signature** across the European Union. Basis: Article 25(2) of Regulation (EU) No
  910/2014 (eIDAS). In Portugal, implemented by Decreto-Lei n.º 12/2021, of 9 February.
- **There are three levels of electronic signature**: simple, advanced and qualified.
  Only the qualified level is equivalent to handwriting by force of law.
- **Signatories do not need EU residency or a national eID** to obtain a qualified
  signature: identity can be verified remotely and a qualified certificate issued in
  their name. This matters for non-EU companies signing contracts governed by EU
  national law, for example German contracts requiring written form under §126a BGB.
- **Chave Móvel Digital (CMD)** is the Portuguese national eID means that produces
  qualified signatures, with no card reader required.
- **SCAP** proves professional attributes in the document itself (acting as a company
  director, lawyer, engineer), so a certificate does not have to be attached separately.
